At Pixcham International j.s.a., we strive to move humanity forward by supporting self-expression, bringing the world closer to people and spreading joy. We are convinced that individual self-expression is a key element of our platform, and we believe that an environment that fosters diversity and inclusiveness is the best way to achieve our goals. By setting a minimum age of 16 for access to our community, we protect younger people and ensure that their experience on Pixcham is safe and appropriate.

Our Community Guidelines were created to support our mission by enabling diverse forms of expression while ensuring the safe use of our services every day. We want these Guidelines to be clear and easy to understand for all our members. We strive to be proactive guardians of the Pixcham environment by identifying and quickly responding to Content or conduct that could endanger our community.

These Guidelines apply to all Content, which includes all forms of communication such as text, images, links or attachments and other creative tools, and to conduct on Pixcham, including participation in Challenges and 1vs1 Battles — and they apply to all Pixcham Users, Challenge Organisers and other third parties. We are highly sensitive to Content or conduct that may pose a risk of serious harm to Pixcham Users, and we reserve the right to take action against anyone who engages in such conduct. Challenge Organisers agree to additional guidelines, including the requirement that their Content be accurate and, where applicable, verified.

In this document and within our Terms of Service, we have established specific rules regarding Content that is prohibited on Pixcham, and we strive to enforce these rules consistently. When enforcing these rules, we take into account the nature of the Content, including its relevance, factual information and its relationship to topics of politics, society or other important matters for our community. We reserve the right to assess whether Content or conduct complies with our Community Guidelines. We will inform the User of any decision to moderate Content or of any action taken against a User’s account, stating the reasons and providing guidance on the remedies available; the User has the right to object under the “Reporting, enforcement and objections” section below. Together we can create a community that spreads joy, fosters diversity and allows everyone to express their voice on Pixcham, where all can have safe and positive experiences.

We remind all our Users, Challenge Organisers and third parties that they are responsible for the Content they share on Pixcham. We ask you to comply with our Guidelines and not to share Content that could cause harm to others or violate our Terms, Guidelines and rules.

Protection of minors

The safety of minors is an absolute priority for us. Only persons aged 16 and over have access to the platform, and the participation of minors aged 16 to 18 in Challenges is subject to the verified consent of a parent or legal guardian in accordance with the Terms.

If we suspect that a minor is at risk, we act without delay and, in serious cases, inform the competent authorities.

Authenticity of content and Selfies

Pixcham is based on real, unedited photographs. Every Selfie uploaded to the App must be an authentic photograph taken with your device’s camera in real time.

We consider a breach of the authenticity rule to be a material breach, which may lead to immediate disqualification from a Challenge or 1vs1 Battle, forfeiture of Prizes and deactivation of the account. The Company is entitled to use technical measures to detect AI-generated or edited content.

Deepfakes and synthetic identity

In addition to prohibiting edits of your own Selfie, we also protect the identity of other persons and the integrity of the real world.

These rules apply regardless of whether the content is labelled as AI; what is decisive is the risk of confusion with a real person or event.

Manipulation of competition results

Pixcham is a game of skill. The fairness of results is essential to us, which is why we strictly prohibit any artificial influencing of the course or outcome of Challenges and 1vs1 Battles.

In the event of a breach, we may cancel the results achieved and Points, disqualify the User from the Challenge, refuse or withdraw the Prize and deactivate the account under the “Reporting, enforcement and objections” section.

Fairplay. Every User starts at 100%. For each confirmed instance of cheating (for example, a non-authentic Selfie), the rating is reduced by 20%. After five breaches (0%), a 7-day playing restriction follows. The User can see their current Fairplay rating in their Profile.

Dangerous activities

We welcome the active participation of our community in fun and creative Challenges. Most Challenges are fun and acceptable for everyone because they bring people together. However, we are aware that there are also Challenges and Selfie Tasks that may be dangerous or pose a risk of injury. Before performing a Selfie Task, Users are obliged to carefully consider the risk associated with the Selfie Task. If you find yourself in a situation where you identify a dangerous Selfie Task or Challenge on Pixcham, it is important to pay attention to it.

Assessment of Challenge risk. The Company is entitled, before publication or during its course, to review, suspend or remove a Challenge or Selfie Task which, in its assessment, poses an increased safety risk or a risk of physical harm.

Sexual Content and sexual exploitation

Our priority is to ensure that our Users have control over what Content appears on our platform and that they do not feel threatened by any sexual Content.

Harassment and bullying

We are convinced that every User should have the right to share their thoughts and creativity without worry. These Guidelines are here to protect our Users and ensure that everyone can enjoy the benefits of Pixcham in a positive and respectful environment.

Suicide, self-harm and eating disorders

We are convinced that Pixcham should be a place where self-confidence is strengthened and, at the same time, negative comparison with others is not spread. Our goal is to create a safe space where you can openly express your thoughts.

Shocking and explicit Content

Pixcham is unique in its ability to offer entertainment and the discovery of new Content. Our platform is focused on a positive experience, which is why we do not support Content intended to deliberately shock, disturb or evoke unpleasant feelings in other Users. We understand that such Content can be irritating and cause psychological discomfort, so we draw your attention to the fact that our goal is to keep the platform friendly and safe.

Threats, violence and harm

At Pixcham, we build bridges, not walls, and we create a digital world where Users can meet in a safe, respectful and supportive environment.

Harmful false or misleading information

We believe that the digital world should be a place where you can share truthful stories, find inspiration and trust the information you obtain. Our effort lies in creating a virtual reality where truth is a precious treasure.

Illegal activities

We welcome creativity and freedom of expression, but we are not a place for illegal activities. We believe in the creative potential of our Users, while also striving to create a safe environment for everyone. We believe that we are creating a place where you can develop your talents and hobbies within legal frameworks.

Terrorism, violent and hateful organisations

Our platform is dedicated to promoting a culture of love and mutual respect. It is a place where you can express your creativity, but we do not accept Content that spreads hatred, discrimination or incites violence. Terrorism and violent extremism are unacceptable to us, and we do not support Content that promotes them. At Pixcham, we believe in the power of selfies that spread love, mutual respect and understanding.

If we find that such an entity could be present on our platform, we will carry out a thorough review, including off-platform conduct, which may lead to the blocking of the account and reporting to the competent authorities. No one is permitted to promote or significantly support violent or hateful entities.

Rights and obligations of Challenge Organisers

The Guidelines protect not only Users but also Challenge Organisers and the integrity of their competitions.

Prizes and rewards

Platform security

Be sure to avoid clicking on suspicious links and do not respond to requests concerning the details of your Pixcham Profile, including passwords, authentication data, finances and personal information. If you need more information about how we secure your privacy and safety on our platform, you will find it on our Website.

Reporting, enforcement and objections

Content that you find inappropriate can be reported through (a) the reporting mechanism directly in the Pixcham App, (b) the e-mail address legal@pixcham.com, or (c) the contact form at https://www.pixcham.com/contact (which allows you to report a problem regardless of whether you have an account). Our team will assess each report promptly, objectively and without discrimination.

If a breach is identified, we may take measures including the removal of Content, restriction of the account’s visibility or its deactivation. We will inform you of such a decision without undue delay, stating the reasons, the legal or contractual basis and guidance on how you can appeal. If your activity poses an immediate threat to the lives of others, we will inform the competent law enforcement authorities. After your account is deactivated due to a breach of our Terms, you must not use the platform again or attempt to circumvent this measure.

You have the right to object. If you disagree with our decision on Content moderation, the deactivation of your Profile or the restriction of functionality, you may submit an objection via the form in the App, within six (6) months of the decision. The objection will be assessed by a human, and we will inform you of the outcome. You also have the right to turn to a certified out-of-court dispute settlement body under Article 21 of Regulation (EU) 2022/2065 (Digital Services Act) and to the competent court. The procedure and time limits are further governed by Section 7.19 of the Terms of Service.

Moderation transparency. When detecting breaches, we may use automated systems, including artificial intelligence systems; final decisions are subject to human review where required by law or by the nature of the case. We apply measures proportionately according to the severity and recurrence of the breach, generally from the mildest to the strictest:

  1. Warning — for a first or less serious breach.
  2. Restriction of features — temporary restriction of the visibility of or access to selected features.
  3. Disqualification — exclusion from a Challenge or Battle, and possibly forfeiture of Prizes and Points.
  4. Temporary deactivation — suspension of the account for a repeated or more serious breach.
  5. Permanent deactivation (ban) — for the most serious or repeated breaches.

In the case of particularly serious breaches (especially endangering minors, deepfakes, malware, serious manipulation of a competition), we may proceed directly to permanent deactivation. The right to object under this section applies to every measure.

Pixcham International j.s.a. reserves the right to block access to or cancel the account of Users where this is necessary to protect the safety of other Users on Pixcham or beyond it (for example, leaders of hate groups or terrorist organisations, persons with a history of inciting violence or perpetrators of serious injuries). In making this assessment, we may take into account the advice of experts or cooperate with the competent authorities.

Transparency report. The Company may regularly publish aggregated data on Content moderation, reports received and the enforcement of rules.

We are proud of our active and engaged community. We work with you to continuously improve the platform and to create a safe and positive online environment.

Relationship to the Terms and the Privacy Policy

These Community Guidelines form an inseparable part of the Pixcham contractual framework, together with the Terms of Service and the Privacy Policy. In the event of a conflict, the Terms of Service shall prevail. The Company is entitled to update these Guidelines on an ongoing basis in accordance with Section 18.1 of the Terms. The current version is always available in the App and on the Website.
